In a surprising turn of events just a day before the Delhi Assembly elections, the capital’s police have filed cases against both Delhi Chief Minister Atishi from the Aam Aadmi Party (AAP) and Manish Bidhuri, the nephew of BJP’s Kalkaji candidate Ramesh Bidhuri. These cases, centered in the Kalkaji assembly constituency, highlight the tension and scrutiny over adherence to the Model Code of Conduct (MCC) as Delhi gears up for voting.

Atishi has been implicated in two separate incidents. In the first case, she allegedly led a large group of supporters, numbering between 50 to 60, to Fateh Singh Marg in 10 vehicles, which is considered a violation of the MCC’s rules on public gatherings during the election silence period. The second case involves her supporters, accused of obstructing government work and physically confronting police personnel.

Atishi took to X to voice her concerns, alleging that the police detained two individuals who were documenting MCC violations without any legal basis. She pointed out the apparent double standards in enforcement, claiming no action was taken against others who were also breaching the MCC.

On the other side, Manish Bidhuri, along with Ravi Dayama, has been named in a case for similar violations of the MCC. According to the complaint filed by Atishi, Manish was found with non-locals in Kalkaji, contravening rules meant to prevent external influence during the silence period before elections. However, despite the police action, some reports suggest that upon inspection, no clear violations were found linked directly to Bidhuri’s family.

These cases come at a critical juncture, potentially influencing public perception and the electoral atmosphere. With elections just around the corner, such legal actions could sway voter sentiment, especially in a constituency like Kalkaji, where both leaders have significant stakes. The cases under Section 126 of the Representation of People’s Act, which deals with restrictions on public meetings during the silence period, underscore the importance of maintaining election integrity.

This legal drama unfolds in a political landscape where every move is scrutinized. The AAP has often positioned itself as a party fighting against corruption and for the common man, while the BJP has been known for its strong organizational capabilities and influence. The allegations and counter-allegations of MCC violations reflect not just the intensity of the electoral battle but also the complexities of managing political activities under the strict guidelines of election laws.

As Delhi prepares to vote, these cases serve as a reminder of the fine line political leaders must walk between campaigning and adhering to legal frameworks designed to ensure a fair election. Regardless of the outcomes, these incidents will likely fuel discussions on political accountability and the enforcement of electoral rules in one of India’s most watched political arenas.
